He was a Farmer (1880); farm laborer (1900); vegetable man - streets (1910.)6,2,3 He was enumerated on the census in DeKalb County, Georgia (1850); Ellis County, Texas (1880) Dallas County, Texas (1900); Ellis County, Texas 1910, 1920.) The following is believed to have been researched and written by Mary Elizabeth "Elizabeth" (McCoy) Hayward, wife of Sumner Hayward, 224 Richards Road, Ridgewood, New Jersey. It was attached to a letter she had written on January 30, 1958 and found in the records of the Washington County, Indiana Genealogical Society. Elizabeth was a professional genealogist and I suspect she was researching Manen Lot Payne for someone else. Recent research has answered some of Elizabeth's questions.
THE PUZZLE OF M. L. PAYNE
William Payne (1804 - 1874) and his wife Elizabeth Dawalt (various other spellings used (1809 - 1909) had, among other children, a dau. Martha Jane, b. 1847. They lived at various places in Ohio, Ind.., Ill., and Tex. In 1863 William Payne was clerk of the Bapt. chh. at Utica; in 1865 of the same at Pekin. Washington co., deed indices show that he bought and sold land there (C-161, I-532, 538, G-190, S-315, 467, L-222, V-123) but I have only the refs. just noted, not the dates. By 1872 this couple were in Waxahachie, Tex., where both d. and are buried. Problem #1 is to fix the exact dates of their various moves and to discover just where they lived at what times.
To their home, presumably in Washington co., during the Civil War there came a very young man, Manon or Manuel Lot Payne. Here we come to the real mystery, for no less than 6 people have agreed on the fact that his story is muddled but none can straighten it out -- nor can I. M. L. Payne's family came from Villa Rica, Ga. (but a search of the 1850 & 1860 Census, which I made at Savannah, does not show him as a member of a household in that area). Several of his descendants have given the date of his birth as Mr. 11, 1842 BUT he is said to have been in the Confederate army at the age of 14, which just doesn't jibe. The tradition is that he was shot in the back on the neck, carried the bullet the rest of his life and consequently could not hold up his head properly. That last bit is more than tradition -- several people who knew him vouch for his peculiar posture. He may have been a deserter, which would account for his arrival in Indiana under cloudy circumstances, and maybe for his being shot in the back. He worked for the Paynes (query -- was his real surname Lot, and did he adopt the Payne surname to cover his tracks and the possibility of being court martialed?) My. 16, 1867, in Ind. (Where?) he m. Martha Jane Payne, mentioned above -- the marriage being strongly opposed by Elizabeth (Dawalt) Payne. The opposition was based, according to tradition, on his being "frivolous," even to the point of playing the fiddle (this would have been a grave offense in the eyes of a strict Baptist family of that day.) At any rate, his mother-in-law never forgave him and left the family home in Tex. to a different dau. than Martha Jane, also cutting him and his wife out of her will. As Elizabeth (Dawalt) Payne reached the overripe age of 100 she had plenty of time to think it over! Problem #2: did the marriage of M. L. Payne and Martha J. Payne take place in Washington co.,? If so, do the records add any details, such as the age of the groom and the names of his parents? If the date of the marriage, My. 16, 1867, and that of the birth of the first child, My. 6, 1868, are correct (and I have only the say-so of descendants) then it was no shotgun marriage.
Among the fruitless searches already made are: search of Ga. census, as mentioned above; search of Terre Haute census for 1870 (there was a statement made that this was the residence of the family in 1872); and on-the-spot inquiry made in Villa Rica, Ga., by a descendant just a year or two ago; hunt for family Bibles; inquiry as to Confederate records. Anything that will throw light on this puzzle will be welcome, especially any records showing Washington co., doings. Are there old tax lists, for instance: I doubt if M. L. Payne ever owned property there but if any of his children were born there would their names, and his, be on the record? Church records would hardly be useful, considering the "frivolous" nature of the man but possibly his wife belonged to either Utica or Pekin Baptist church before they were married. If so, the date of her dismissal might be found. Both M. L. Payne and his wife d. at Waxahachie, Tex., he Ja. 22-23, 1926 (d. in the night, in his sleep, hence the uncertainty) and she Sp. 25, 1928, and are, I presume, buried there. They had 8 chn., with several of whom I've corresponded.

Mama had a fever when she was a young girl. It left her slightly palsied. She taught school for a while before she married. It was hard for her to write. Her wedding ring was made from a twenty dollar gold piece and was heavy for a ring. If we did anything wrong, she would thump us on the head. Dad caught her one day and made her stop.
