UNITED STATES SUPREME COURT CASE

In the 1930s and 1940s, Duncan and Helen Davault were involved in a lawsuit that went all the way to the Supreme Court of the United States. Here is a brief summary of the case from what I can glean from the published records (U.S. Supreme Court Records and Briefs, 1832 - 1978).
Duncan and Helen owned a piece of property described as the North one-half of the southwest one-quarter (excluding the north 165 feet of the east 279 feet) of Lot 18, the north 165 feet of the east 279 feet of Lot 18, the southwest one-quarter of the northeast one quarter and the northwest one-quarter of the southeast one-quarter of Lot 18, all in Rancho Ex-Mission, Horton's Purchase, San Diego County, State of California. During the tax years of 1934 and 1935 the county tax assessor illegally exempted a large number parcels causing the remaining property in the district, including those parcels belonging to the Davaults, to be assessed for the entire tax burden of the district. This resulted in tax assessments that greatly exceeded the assessed value of the property. The following examples were given: one parcel, where the assessed value was $1,720.00, was sent a tax bill of $366,362.27; on a second parcel, assessed at $100.00, the demand was for $40,187.92 and a third parcel, assessed at $7, 390.00, the demand was the staggering sum of $1,648,446.40.
Although the assessments were illegal under California law, the state, due to the property owner's failure to pay the tax demands, took title to the parcels on July 1, 1936. The State of California eventually sold the Davault's property to Charlotte Erickson.
For reasons not specified, it appears that the Davaults sued Charlotte Erickson to regain title to their property rather than sue the State of California. The case was eventually heard by the District Court of Appeal, Fourth Appellate District, of the State of California. During the case it was shown that the Davaults were unconstitutionally deprived of their real property without due process of law, that they were denied equal protection of Section 1 of Article XIII of the California State Constitution and deprived of the protection afforded by the Fourteenth Amendment of the Federal Constitution. It was further shown that the San Diego County Assessor, County Tax Collector and the County Board of Supervisors of San Diego County had failed to recognize the petitioner's rights and to furnish protection. The California Court, however, held that all inquiries or protests were barred by the Statute of Limitations contained in the Revenue and Taxation Code. On July 24, 1947, the case was decided in favor of the respondent, Charlotte Erickson, and against the Davaults.
The case was referred to the Supreme Court of the State of California and said court denied the Petition of Hearing on September 18, 1947.
The case was referred to the Supreme Court of the United States for the October Term, 1947. The documents do not say what happened but I suspect the United States Supreme Court also declined to hear the case.

Note: Rancho Ex-Mission San Diego was a 58,875-acre Mexican land grant in present day San Diego County, California given in 1846 by Governor Pio Pico to Santiago Argüello. The rancho derives its name from the secularized Mission San Diego, and was called ex-Mission because of a division made of the lands held in the name of the Mission — the church retaining the grounds immediately around, and all of the lands outside of this are called ex-Mission lands. The grant extended eastward from the San Diego Pueblo to Rancho El Cajon, and encompassed present day east San Diego, Normal Heights, La Mesa, Lemon Grove, and Encanto.

William Henry Knox, son of David Franklin Knox and Catherine Davault Knox was born near New Florence, Missouri, January 1, 1863, and departed this life at his birthplace on August 25, 1944, at the age of 81 years, 7 months and 24 days.
On October 23, 1890, he was united in marriage to Miss Nellie Bordeaux. To this union three children were born -- David Franklin of New Florence; Clara Louise, now Mrs. E. H. Duebbert of New Florence; and William Henry, Jr., of St. Louis, Missouri.
Besides his devoted wife and children he leaves to mourn his departure three grandchildren Dorothy Louise Duebbert, Mildren Knox Duebbert, and Jimmy Knox all of St. Louis, Missouri; one brother, J. U. Knox of New Florence; three nieces, Edna Louise Goss, Georgia Knox Goss, and Mildren Knox Goss of San Jose, Calif; one nephew Eldon L. Goss of Oakland, California; and many other relatives and friends.
For over fifty years Mr. Knox was a member of Florence Lodge, No. 261, A. F. & A. M. He was also a member of Triune Chapter, No 93 Royal Arch Masons of Wellsville, Missouri, and Centralia Council, No. 34 Royal and Select Masters of Centralia, Missouri. He was a charter member of the New Florence Chapter of the Order of the Eastern Star, acting as the chapter's first patron.
Mr. Knox, a representative of one of the pioneer families of the county, was at the same time a man who by his own exertions and merits placed himself among the leading successful farmers of the county. In the absence of his father from ill health, he undertook the entire management of several farms when he was quite young to assume such responsibility. From that time until his death he was actively engaged in farming. The general esteem in which he was held was the result of his high character, his many estimable qualities as a neighbor, and his well-known integrity and upright life. The warmth of his hospitality will always be remembered by the many persons who visited in his home.
Thus ends a fruitful life that may serve as an example to the generations which follow him.

"Twlight and evening bell
And after that the dark!
And may there be no sadness of farewell,
When I embark;
For though from out our bourne of Time and Place
The flood may bear me far,
I hope to see my Pilot face to face
When I have crossed the bar."

Funeral services were held at the home Sunday afternoon, at 2:30 o'clock conducted by Rev. Paul C. Paschal, who paid a very beautiful tribute to the memory of the deceased. Burial was in New Florence Cemetery. Services at the grave were conducted by the Masons. The floral tributes were very beautiful and profuse attesting the esteem in which he was held.

Mrs. W. H. Knox Dies At New Florence
Nellie Irene Bordeaux, daughter of Edward and Martha Kely Bordeaux, was born in Shipman, Illinois, on January 25, 1872, and passed away at her home near New Florence, Missouri, on September 24, 1952.
On October 23, 1890, she was united in marriage with William Henry Knox. To this union three children were born: David Franklin, of the home; Clara Louise (Mrs. E. H. Duebbert), and William Henry both of St. Louis.
In early life she united with the Methodist Church of New Florence and ever lived a Christian life. She was a charter member of the Order of the Eastern Star of the New Florence Chapter and was one of its early Past Matrons. At the time of her death she was a member of Montgomery Chapter No. 388. She held membership in the New Florence Rural Extension Club and had been a member of an extension club longer than any other person in this county. She was also a member of the New Florence Study Club.
Mrs. Knox possessed a cheerful disposition and numbered her friends by her acquaintances. Her hospitality was renowned, and many happy hours were spent in her home by friends and relatives. She had a vast knowledge of practical things, and many times her advice was sought by those less experienced and less skillful than she. As she became more advanced in years her interests remained varied, and her energy was remarkable.
A great bond of affection existed between her and her son-in-law and daughters-in-law, one of whom lived in her home for many years.
Besides her devoted children she leaves three granddaughters; Dorothy Louise Duebbert, Mildred Knox Duebbert, and Nancy Carol Knox, of St. Louis; a grandson James Knox; a brother, Luther Bordeaux of Montgomery City; two sisters: Mrs. Rose Barnes of Cuba, Missouri, and Mrs. M. A. Green, of Montgomery City; two daughters-in-law, Mrs. W. H. Knox, of St. Louis, and Mrs. D. F. Knox, of the home; a son-in-law, E. H. Duebbert, of St. Louis; two sisters-in-law: Mrs. Gene Bordeaux, of Chamelon, Illinois, and Mrs. Luther Bordeaux, of Montgomery City; one brother-in-law, M. A. Green, of Montgomery City; besides many other relatives and friends.
Funeral services were conducted Friday afternoon at 2:00 at the New Florence Methodist Church by a former paster, Rev. P. C. Paschal, assisted by Rev. Jon Kirk, with interment in the New Florence Cemetery under the direction of the Eastern Star.
Those from a distance attending the funeral were E. H. Duebbert, Misses Dorothy and Mildred Duebbert, Mr. and Mrs. W. H. Knox, Jr., and daughter Nancy, Mr. and Mrs. Gene Creissen, Mrs. T. I. Tritch, Mrs. A. C. Kercher, Mrs. Lynn Ward, Miss Bernice Bordeaux, of St. Louis; Mr. and Mrs. Lewis Wilson and Mr. and Mrs. Robert Wilson, of Fulton; Tinsley Bordeaux of Terra Haute, Indiana; H. W. Dornan of Labadie; and Miss Dora Crane of Warrensburg.

Last Tuesday evening the 4th at 6:30 o'clock, Miss Clara Knox was united in marriage to Mr. Elmer Duebbert at the splendid Knox home south of town. With Miss Geneva Ellis at the Piano, the young couple was escorted into the lighted parlor by Mr. Frank Knox and Miss Martha Powell, where Rev. Arbuthnot performed the ceremony using the ring service. Rev Arbuthnot introduced the ceremony with appropriate remarks that seemed to drive the usual tenseness of such occasions. Elmer and bride drove to town and left on the evening train for a short stay. They will reside in Mexico Missouri, where Elmer has a position with the Pollock Milling Company.
Miss Clara is the only daughter of Mr. and Mrs. W. H. Knox and the good wishes of our community go out to her and Elmer in their new relationship.

OBITUARY

John U. Knox Dies At
His Home Sunday

John Upton Knox, 74, well known farmer and son of one of Montgomery County's pioneer settlers died Sunday morning at his home one mile west of New Florence after a short illness.
He had been under the care of a doctor for the past two weeks and was believed to be improving when he was found seriously ill Sunday morning by Albert Hahn. A doctor was called, but he died a short time after.

His grandfather, the late David F Knox was one of the pioneer settlers of Montgomery County. He settled near the present site of New Florence in 1818 after moving west from Kentucky. He was married to Sarah Clark of Kentucky and they reared five children.

The youngest of the children, David R. Knox, married Miss Catherine Davault, a member of another pioneer family. To this union four children were born, Sarah l., William H., Mary Lula, and John Upton, who was born May 19, 1872. The other three preceded J. U. in death.

His early childhood was spent with his parents at their farm near New Florence. He later attended Missouri University. He later was in business in St. Joseph, Mo., for two years. While at St. Joseph he met and married Miss Honorah Hunter, of Taris, Ill., on May 16, 1894.
They then moved to their home on the site of the historical Davault Tavern one mile south of New Florence where thay lived for the remainder of their lives. Their homesite is marked by a DAR marker as one of the historical places of Missouri.
Mr. and Mrs. Knox adopted Miss Martha Talbot, now Mrs. Thos. Farnen of Warrenton, when she was a child and she has been as a daughter to them through the years.
Mr. Knox was for many years a breeder of fine horses some of his stock being prize winners in horseshows throughout this middle west. He had however gone out of the stock breeding business.
He was an ardent football fan and was able to see one Missouri University game this fall.
He was one of the leaders in farm improvement and work in this county and devoted much time toward the betterment of farm condition in this county.
He was a member of the Methodist church, the MWA and numerous other organizations. For many years he had been a representative of the Montgomery County Mutual Fire Insurance Company.
Funeral services were from the home Tuesday afternoon by Rev. M. T. Workman. Interment was in the Jonesburg Catholic cemetery.
His passing marks the departure of one of the county's widely known men. His friends were many and his name respected wherever he was known.
This newspaper extends sympathy to the bereaved daughter and the other relatives in his passing.

Notes on adopted children, Hale and Martha Antoinette Talbot:

The Peter Davault home (DeVault Tavern - Missouri) passed to John from his parents. He and Nonee lived there all their married lives.
John and Nonee Knox did not have children of their own; however, they did adopt two children, siblings Hale and Martha Antoinette Talbot. Apparently Hale did not like the arrangement and left home as a young adult. As far as I can tell he never returned. Martha stayed with John and Nonee and when John died in 1946, she inherited the family home. I belived she was the owner until the mid-1970s when it was raized to make way for Interstate 70.
I have tried to track down the parents of Hale and Martha. The Talbots were an important family in early Missouri. I suspect that in someway the Talbot children were related to John Knox. In the 1910 Census John lists Martha Talbot as a cousin. John was the grand-nephew of Susan A. Clark. Susan had married David Irvin Talbot. There may have been other connections to the Talbot family.
I found Hale Talbot in the 1900 Census for Elkhorn, Warren County, Missouri. He is shown with his parents, but I am not able to read their names. There are actually three Talbot families shown on this page:
1) The head of the first family is Irvin Talbot (b. Apr 1836 in Missouri, widowed, both parents born in Kentucky) and son Christopher (b. Mar 1875 in Missouri, single, both parents born in Missouri).
2) The head of the second family is Unknown Talbot (b. Apr 1871 in Missouri, married 3 years, both parents born in Missouri). The census index gives his name as "Irene." It looks to me like he, too, might be an James, Isaac, Irvin or Isham. Also in this family are wife "Jeriun," her name is also hard to read, (b. Jan 1879 in Missouri, married 3 years, 1 child 1 living, both parents born in Missouri) and son Hale (b. Nov 1898 in Missouri, single, both parents born in Missouri). This is the Hale Talbot adopted by Knoxes.
3) The third family is headed by William Talbot (b. Dec 1868 in Missouri, married 5 years, both parents born in Missouri). Also in the family is wife Rettie (b. Jan 1868 in Missouri, married 5 years, 3 children 2 living, father born in Germany and mother born in Missouri). The two children in this family are Irvin C. (b. Feb 1895 in Missouri, single, both parents born in Missouri and an unnamed son, (b. Apr 1890, single, both parents born in Missouri).
I am guessing that the Irvin Talbot, head of the first family, is the father of the heads of the other two families. It is also just a guess, but this Irvin Talbot may be the second son of Isham H. Talbot (b. abt. 1805 in Kentucky).
Additional information has come to light on the third family. The head is William Irvin Talbot (b. Dec 1868 in Missouri - d. 29 May 1947 in Dallas Co., Texas); wife Rettie Emmel (b. Jan 1868 in Missouri - d. 29 May 1946 in Dallas Co., Texas); son Clark Irvin Talbot (b. 20 Feb 1895 in Missouri - d. 31 Aug 1988 in Dallas Co., Texas); son Porter William Talbot (b. Apr 1900 in Missouri - d. 17 May 1955 in Ellis Co., Texas); son Georgio (b. abt. 1904 in Oklahoma) and daughter Cora (b. abt. 1907 in Missouri).

New Florence, MO. Wed. evening

My dear Minnie :- Was so very glad to get your letter today for we have all worried so much about you & I've said a dozen times that knew you were surely not well or you would have written. I hope you are better now & will soon be feeling better. You have had so much it isn't easy to get over soon. But do hope you will soon get stronger. Don't try to do much, perhaps when spring comes you'll feel better. Mose & Harold are at church, a revival is going on & M. thinks he must go at least part of the time. I've been rather busy since Xmas, one week cold packed beef, put up 12 cans, & another week had a dressed hog & had to make lard, sugar cure hams & one shoulder & sides, & H. & I made 25 lbs. sausage, then I fried down in qt. jars part of the sausage, then last week on Friday afternoon I had a little "Stork Shower" for a neighbor who was moving to near Mexico. On Sat. had company, & again on Sunday had John & Maggie Lavender from McKittrick all day, one week made little mince-meat, one week cooked my big pumpkin & cold packed it so really haven't had a minute , & this week since Sat. I've really been almost sick with a very bad cold, is some better now. M. had it. Mama has some cold but stays in so close, we didn't get to go home Sunday with company. Edith hasn't been up since New Year's Day. Imagine she will be coming home next week or so for a visit. Lillie is fine, hasn't been as busy since Xmas as before. How is June? You didn't say if she had gone back to school. Tell her H. went skating last night & is going again after church (he didn't want to go to church had to make him). Am going to send you the Leader Minnie. Maybe you can hear what we are doing that way, altho news is mighty scarce now, so quiet. Edith wrote that Jack was better, she was out last week to see them, & that Annie was trying to get on the Radio, Mr. Pfaff was feeling very well. Have you gotten you a Radio yet? If not get one they are lots of company, sometimes I turn ours off because I need quiet, I hear so much noise all day am tired at night. Now minnie the first Sunday you are able & it is pretty I want you all to come down for the whole day. I don't have to know it just come on. I always have enough for extras & we are so anxious for you to come just come any Sunday Geo. can get off & when the weather gets a little warmer you are coming down & stay a week we'll just love to have you & I'm not going to take no. First time can get Howard & Catherine to take a day off am going to make them bring us up, had weather Howard is tired from driving all day week days & I don't go much on Sundays. We have Pusses again for this year so Mose & I will come up some of these times, but we want you all to come just as soon as you feel like it I won't go to any trouble. Do hope you get well soon & try to get an appetite. No trouble to get my family to eat, I'm only afraid thay will over eat. H. has had two spells of indigestion lately from eating too much pie, but he never gets full & is growing so tall. Let us know how you feel & try & rest up, you are just worn out from never resting, so try to rest all you can. Now come down all of you just as soon as you can for want you to. Must close for we go to bed rather early, & get up at 5 on work mornings. Love to all of you Angie Lavender

LAVENDER -- DAVAULT

Some sixty or more friends assembled at the home of Mr and Mrs Alf Davault Wednesday evening the 8th, to witness the taking on of wedding vows by Mr Moses G. Lavender and Miss Angeline Davault.
Introductory to the service, a song, Hearts and Flowers, with transpositions, was sweetly and with appropriateness rendered by Miss Floye See.
In a room trimmed with mistletow, palms and flowers and as the wedding march was being played by Miss Edith Davault, Mr Bruce Davault and Miss Susie Pemberton led the way for the unassuming couple. Rev J W Ham in a very pretty and sufficiently solemn service pronounced them man and wife.
To the dining room next assembled, a full course supper was served which exemplified the splendid reputation of Mrs Davault and daughters as artisans in preparing delectables.
The evening was pleasantly passed and Mr and Mrs Lavender received a shower of congratulations from the friends assembled.
The list of presents was large and contained many handsome and valuable ones.
Miss Angie is the oldest daughter of Mr and Mrs Alf Davault. She is a great favorite, not only with Mr Lavender, but with all. She is one or our best musicians and for church and Sunday School work she is unexcelled. The members of her Sunday School class cling to her with love and affection.
Mr Lavender was born near Jonesburg. Some seven years ago he came to New Florence and began his work with the LEADER and but for a brief stay in Colorado has been with us continuously. His devotion to his work, his exemplary christian life merit from us our highest praise. No young man enjoys the confidence of the people more than he.
They are now keeping house in the White property with life's happiness before them.

Nunnelly -- Davault.

A beautiful home wedding was solemnized Wednesday evening, September 27, 1911, at the home of Mr. and Mrs. Alf Davault, when their daughter, Katharyn Clare, became the bride of Mr. Howard Nunnelly.
Promptly at 8:00 o'clock, the strains of Mendelssohn's Wedding March, played by Miss Edith Davault, sister of the bride, announced the approach of the bridal party. The bride and groom, preceded by the attendants, Miss Susie Pemberton and Mr. Herbert Davault, advanced to the bay window, which had been converted by means of flowers and ferns into a bower of beauty for the occasion where the Rev. Rigg in an impressive manner performed the wedding ceremony. The bridal party then led the way to the tastefully appointed dining room where an elegant supper was served.
The petite and winsome bride never looked more charming than in her wedding gown of soft white silk over white satin, with trimmings of white lace and pearl passamentra over which fell the bridal veil held in place over a wreath of orange blossoms. The bride'smaid was also attired in white silk with trimmings of hand embroidery and lace. The groom and groomsman both wore the conventional black.
They were the recipients of many handsome and useful presents which betokened the high esteem of a wide circle of friends.
The bride is a highly cultured young lady, and has been for a number of years one of the popular teachers of this and adjoining counties.
The groom is the oldest son on Mr. and Mrs. Henry Nunnelly of this place and is a model young man in every respect and well worthy of the bride he has chosen.
They will go to housekeeping at once in the Locke cottage in the east end of town, where the best wishes of their many friends for a long and prosperous journey through life attend them.
