BASIC FACTS

Mariah Cox was born on 15 June 1816 in Washington Co., Tennessee.1 She and David Davault were married on 22 February 1838 in Washington Co., Tennessee.1,5,6 She died on 16 May 1881, at age 64, in Tennessee.1,5 She was buried in Probably in a family cemetery on David's Farm.
Mariah Cox was also known as Maria Cox.7 She was also known as Marie Cox.8 She was also known as Mary Cox.8 She had reference number 403. She was enumerated on the census in Greene County, Tennessee (1850 - 1880.) Finding out who Mariah's parents were was quite a task. The clue that led to solving the mystery came in 2013 when I received a copy of a letter written to President Abraham Lincoln by a (presumed) family friend, N. G. Layton. The letter asked that John Augustus DeVault, then a prisoner in Camp Dougles, the Union prisoner-of-war camp in Chicago, Illinois, be pardoned. In the letter it mentioned that Col. C. P. Byers was John's uncle. This clue led, via a circuitous route, to the information that Charles Potter Byers second wife, Emeline Cox was a sister of Mariah Cox. It also turned out that Charles Potter Byers and his first wife had a daughter that had married Elbert Sevier Cox. We were eventually able to show that Mariah, Elbert, Emeline and several other Cox children were siblings. Several genealogies show that these Cox children, including Elbert, Emeline, Mariah, Caroline and four other Cox siblings were the children of John Cox and Priscilla (McCray) Templin-Cox. Priscilla was buried in Cherokee Community Cemetery in Jonesborough, Washington County, Tennessee. Many genealogies and a Find-A-Grave memorial say that Priscilla's husband, John Cox, who is also buried in the Cherokee Community Cemetery, died in October 1818. This is too early for this John Cox to be the father of Elbert Cox and several of the other Cox children. The mystery was finally solved by the following legal documents, located by Cathy Cook. It hows that the Cox children were siblings and children of John Cox. It also suggests that he died in 1848 and that the 1818 date is probably a gravestone transcription error.

COURT RECORDS

In September 1847, Elbert Cox and siblings, Emaline, Thomas, James C., Mariah, and Caroline were forced to go to court and have their father declared incompetent. The minutes, dated 6 Sep 1847, read: ?

"Upon information being made to the Court by Chas P. Byers and his wife, Emaline, Thos I. Cox, Elbert S. Cox, James C. Cox, David Davault and wife, Mariah, [Hugh] Aiken Crawford and wife Caroline that their father, John Cox is of unsound mind and praying that Jury be appointed to enquire in the mental condition of his mind. It is ordered by the Court that the Sheriff of said county summon a jury of twelve freeholders to ascertain by inquisition such idiocy or lunacy and make return thereof to the Court now in session and also such lands and chattels that he may be possessed of."?

The jury filed this report: ?

"The undersigned freeholders of Washington County, having been duly summoned and sworn by the Sheriff of said County as a jury to enquire into the mental condition of John Cox. After diligently investigating the matter do find that the said John Cox is a lunatic and utterly incapable of managing his own affairs with safety to himself and others; We also find that the said Cox is in possession of 354 acres of land as appears from tax list, valued $3000. We also find him in possession of a black woman, Matilda with five children, value is supposed to be $1600; also 3 black boys and 1 girl as is supposed to be worth $1700; also find in his possession 9 head of horses value $450; also supposed to be 30 head cattle value $125; also 27 head of sheep value $13; also 30 head of hogs value $50; also 2 wagons value $120; also household & kitchen furnature, farming utensils value $300. And from information of the family of said Cox that he has in his possession of some cash notes, be we being unable to ascertain the amount, all of which is submitted to your worships. Given under our hands and seals, this 7th Septr 1847, Laurence Bowers, Jacob Bacon, James Crouch, Charles Basket, Jacob Hilbert, John V. Joss, Joseph Clark, Saml E. Edwards, Wm P. Reeves, Saml M. Hunt, John B. Pritchett, John Crouch.?"

After John was found to be unable to manage his affairs, the court appointed Elbert as his guardian. By February 1849, John had died and Elbert and Thomas were appointed Administrators of his estate.

Sir. John Devault of Greene Co., E. Tennessee, was forcibly seized and against his will put into the Rebel Army - Subsequently he was captured at Cumberland Gap with Genl. Frazier's command . Since then he has been and is now confined as a prisoner of war at Camp Douglas . He does not wish to be exchanged - but desires to take the oath of allegiance and remain North as a loyal citizen of the U States.
He is not twenty years of age. If bonds, in addition to the oath of allegiance, be required - he can make a good bond secured by Col. C P Byers , his uncle, a Tenn. refugee now a citizen of Springfield Massachusetts - who will be his surety for good behavior and fidelity - and that he shall not in any respect become a charge to the U.S.
If you will order his discharge upon these conditions - you will do him simple justice and confer a great kindness upon his relatives here who are genuine devoted Union people & have proved their faith by their sufferings at home and their present exile.

Note: Apparently John was conscripted into the Confederate Army. He was captured by Union forces when General John Wesley Frazer surrendered at Cumberland Gap. The letter worked as John was pardoned and not exchanged back to the Confederate Army. This letter contains an important clue and it was used to solve a long-standing mystery. It turns out that Col. Charles Potter Byers was not John's uncle, as the letter states, but was the father-in-law of Elbert Sevier Cox. Elbert, a brother of John's mother, Mariah Cox, was John's uncle. With that clue we were able to determine the parents of Mariah (Cox) DeVault.

Died of Heart Failure as She Neared Her Old Home in This County.
A peculiarly sad death occurred yesterday afternoon near Clover Bottom, in this county. Mrs. John DeVault, of Greene county, suddenly expired in a hack, as she neared the home of W. M. Bachman. She was accompanied by her daughter, Miss Maud, and was stricken when almost in sight of her old home place that she had not seen in 18 years. She was 73 years of age and was formerly a Miss McClellen, and is a niece of Mrs. E. H. Bachman, of this city. The remains were brought to the home of her aunt, on Watauga avenue last night and will be shipped to Greeneville this morning for burial.

Mrs. Maude DeVault Tucker, 84, of Rt. 5, Greeneville, died at seven a.m. today at Laughlin Hospital.
The funeral will be Sunday at two thirty p.m. at Doughty-Stevens Funeral Home, Dr. W. R. Rollins will officiate. Interment will follow in Oak Grove Cemetery.
Pallbearers will be nephews.
Survivors are one brother, Herbert DeVault, Rt. 5, Greeneville; two grandchildren James N. Tucker and Mrs. Richard Humphreys, both of Greeneville also three great-grandchildren.
She was preceded in death by her husband, John N. Tucker and a son, Clarence Tucker.
She was a member of the Asbury Methodist Church.
The body will remain at Doughty-Stevens Funeral Home throughout the service.

John Nathan Tucker had reference number 408. He was a Salesman - hardware store (1900, 1910); proprietor - hardware store (1920, 1930.)3,4,5 He was enumerated on the census in Greene County, Tennessee (1880, 1900 - 1930.) Census and LDS records indicate that John's marriage to Maude was his second marriage. His first marriage was to Bonnie E. Stephens. John and Bonnie had two sons, William Troy Tucker who died young and Clarence Stephens Tucker. Bonnie died shortly after Clarence was born.

Some LDS records and some genealogies say that John Nathan Tucker was the son of John Tucker and Sarah Jane Bailey. At present, I think this was a different family. In the 1910 Census, John was living alone. His son Clarence was living with his aunt and grandmother.

... Margaret (Brown) Graham remarried to Alden T. Tucker* (1839-1907). Alden Tucker was the son of Alexander Clay Tucker and Sarah Ball Tucker* (1816-1882). He also served in the Civil War with the 1st Tennessee Cavalry Company F. Alden was captured and sent to the Confederate prison at Castle Thunder,Virginia. Alden and Margaret Tucker lived in the Woodlawn area of District 11 of Greene County. In the 1900 census, Margaret stated she had nine children of whom eight were living. Their children were: (i) Sarah Ann Tucker, born c. 1868; (ii) William Alexander Tucker, born 10-3-1873. William served inthe Spanish American War. He was a lawyer in Greeneville, and later moved to Idaho. (iii) FlorenceJosephine Tucker, born about 1872; (iv) John Nathan Tucker, born 1873. John Nathan married BonnieStephens (1879-1908). They had one son before Bonnie’s early death at age 29. John Nathan remarried to Maud Devault (1881-1966), a daughter of John A. and Mollie Devault (buried River Hill Cemetery). The family lived in Greeneville where John Nathan worked as a hardware salesman in his cousin John Tucker’s (1845-1927) hardware store. John Nathan was later a co-owner of the store and lived on Oak Grove Avenue in Greeneville. John Nathan Tucker died in Greeneville in 1949. He and his two wives and his only son are buried at Oak Grove Cemetery. The son of John Nathan and Bonnie Stephens Tucker was: (a) Clarence S. Tucker (1900-1945). Clarence married Willie Cooter (1904-1995), a long time schoolteacher in Greeneville. Clarence and Willie had two children, a daughter Carolyn Tucker Humphreys who lives in Alaska, and a son James Nathan Tucker (1939-1974). Clarence Tucker’s wife, Willie, inherited her stepmother-in-law’s farm known as the Devault Farm located near the Ashville Highway in southern Greene County. A curious turn of events is that the author of this book [Stevie Hughes] now lives on the Devault/Tucker Farm which in 2007 was developed into a residential community.

Note: Contrary to the above article, John Nathan Tucker and Bonnie Stephens had two sons, one died young.

Mr. John N. Tucker, 76, Died Early Today In Hospital
Retired Hardware Merchant Had been In Failing Health
John N. Tucker, age 76, passed away this morning at 2:30 o'clock in a local hospital. He had been in poor health for some time, and after suffering a heart attack, entered a hospital on last Wednesday.
Mr. Tucker, who was one of Greene County's most prominent and beloved citizens, was born in Greene County near Baileyton. He came to Greeneville more than fifty years ago as a very young man, and in 1900 was married to Miss. Bonnie Stephens. Two this union was born two sons, Troy and Clarence Tucker, all of whom preceded him in death.
In 1912 he was married to Miss Maude DeVault, who survives him. The deceased is also survived by his brother, Bruce Tucker, and a sister, Miss Lillian Tucker, both of Baileyton, and by two beloved grandchildren, Carolyn and James Nathan Tucker
In the hardware business for forty years, Mr. Tucker made many friends throughout Greene and adjoining counties. Always genial and friendly, young chil [I think something is missing here.]
The deceased was a member of the Asbury Methodist Church and an active member of the Men's Bible Class of the Asbury Church.
Funeral services will be held at the Doughty-Stevens Funeral Home Thursday morning at 10:30 o'clock, with the Rev. Sullins Dosser officiating. Interment will follow in Oak Grove Cemetery.
Active pall bearers will be Max Easterly, Hugh Tiller, Paul Ford, Henry Seaver, Carroll McInturff, Jr., and George Greene.
Honarary Pallbearers will be members of the Men's Bible Class of Asbury Church.

Herbert DeVault, near Links Hill, 88, passed away Sunday, 2:45 a.m., in Laughlin Hospital. He was a retired farmer. He was the son of the late John and Mary McClellan DeVault and he is survived by cousins.
The funeral will be Tuesday, 10:00 a.m. at Jeffers Mortuary Chapel with interment in Oak Grove.

Miss Stella DeVault, who has been ill for several months, passed away this morning at five o'clock in a local hospital.
The funeral will be held Sunday afternoon at two o'clock from the home of her sister, Mrs. John Tucker, by the Rev. Walter A. Smith. Interment will be in the River Hill Cemetery.
Pallbearers will be Messrs. Andy Stephens, Bob Link, Clark Hensley, George Scott, John Noell and Sid Noell.

Neal Devault, age 43, was killed in a railroad accident Saturday Noon at Shelby, N.C. Funeral services were held this afternoon at 2 o'clock at River Hill, by Rev. J. P. Boling. Mr. Devault is survived by one brother, Herbert, and two sisters, Mrs. John Tucker and Miss Stella Devault.

Samuel Kitzmiller Davault had reference number 413. He was a Merchant (1850), (with Samuel Backman owned a business that operated under the name of "Backman and Davault"; later a grocer; farmer (1860 - 1880.)1,3,4,5,6 He resided in House in Leesburg, Washington Co., Tennessee that his father lived in while building the DeVault Tavern.1 He was enumerated on the census in Washington County, Tennessee (1850 - 1880.) Samuel DeVault was the eighth child born to Frederick and Margaret Davault. He was born in 1824 at the DeVault Tavern in Leesburg, Tennessee. In 1848, Samuel married Nancy Kitzmiller, the daughter of his first cousin, David Kitzmiller. Samuel and Nancy were married in her parent's large 2 1/2 story brick home on near Buffalo Ridge. At the time it was built, it was the finest home west of Roanoke, Virginia. It was reported to be a double wedding, with Nancy's sister, Sarah Kitzmiller marrying Samuel Bachman.

After the wedding, according to Russell (Frederick Russell) DeVault, Samuel DeVault and Samuel Bachman went into business together in Leesburg under the name of BACHMAN AND DAVAULT. The building they used was the same building that Frederick Davault had lived in while building the Tavern. The two families were living together in Leesburg. By 1860 the families were no longer living together. The Bachmans having moved to Sullivan County near Kingsport.

Samuel and Nancy had settled on a farm at Cedar Creek near Jonesboro and opened a grocery business. They joined Buffalo Ridge Baptist Church, the first Baptist church in Tennessee. Nancy's brother, David, and grandson, Robert, were ordained there. Samuel and Nancy's son, Frederick, was pastor at Buffalo Ridge from 1905 - 1910.

In 1860, Samuel and Nancy's two-story frame house was completely destroyed by a cyclone. Their son Frederick, then 12 years old was left sitting on the fireplace hearth. Pieces of the house were found miles away in Elizabethtown. They knew the pieces were from their house since it was the only painted house between Cedar Creek and Elizabethtown.

Some time after 1875 Samuel changed the spelling of his name from Davault to DeVault. His daughter, Sarah, died in 1876 and the name is spelled Davault on her stone.

Both Samuel and Nancy are buried in the Buffalo Ridge Cemetery.

WILL AND SETTLEMENT OF ESTATE OF SAMUEL DEVAULT

In his will, dated April 18, 1895, he left to his daughter, Mary A. Boring, part of his farm (101 acres) as follows: "Beginning at a white oak corner, Hodges corner, with his line south 80 poles, across a spring branch to a stake at black oak pointer, thence west 61 poles."
"The remainder of the farm of 169 acres and the home to his wife, Nancy DeVault, if she survives me, during her natural life."
"After the death of my wife Nancy, I will and bequeath to my son, Frederick W. DeVault, his heirs and assigns a tract of land of 169 acres and the home."
"I will and bequeath that my son, F. W. DeVault, have the use of a wagon road passing throught the west end of the 101 acres."

She was enumerated on the census in Greene County, Tennessee (1850, 1860); McCracken County, Kentucky (1880); Greene County, Tennessee (1900, 1910); Lake County, Florida (1920.) In the 1850 Census for Greene County, Tennessee, Sarah is shown living with her aunt, Mary Ann (Davault) Duncan. It was probably just a short visit. Just a week later, in the same census, she was shown living with her parents. In 1880, Sarah and her husband, Samuel Fitch, were living in Paducah, McCracken Co., Kentucky. In 1920 Sarah was living in Umatilla, Lake County, Florida. It looks like she owned a home and had rented part of it out.

The book "Pioneer Families of Missouri" by Wm. S. Bryan and Robert Rose, 1876, says she moved to South Carolina. I suspect this is in error.

LETTER FROM SARAH PRISCILLA (DAVAULT) FITCH TO MARY JANE (DEVAULT) GUERRANT

I suppose you have been looking for a letter from me for some time. I did not get home as soon as I expected, and Mr. Fitch has been quite sick with a very severe cold, and I have been very busy cleaning up the house, so you must excuse me this time. I went up town the other day to see about that skirt. Went to several places. So I left it at the best and cheapest place. The lady said the silk you sent would not do; that she would send it back; and that she would find the silk and do it for $8 eight dollars. I saw the pattern it is beautiful. She wanted ten dollars for it but I got her to do it for eight. She said she would have it done the last of next week. I know this lady will be pleased with it. Mr. Fitch was very proud to see me and all of my friends. Mr. Fitch said I ought to have brought little Mary home with me. I told him how pretty and sweet she was up at your house and all were well and that Uncle Jim had just left their house. She asked him what he was mad at you for; he said you said he drank too hard to marry and he knew you did not want him to marry any body. You had better do like me; not have anything to do with him. Mary I shall not soon forget my visit at Mt. Sterling. I enjoyed my self so much. I hope you will soon make me a visit. You must write soon. Mr. Fitch and myself send much love to Dr and yourself. I send twenty kisses to you sweet ladies. Write soon and let me know what that lady says about that skirt. (That is the price.)

Dr. J. P. Easterly was born in Greene County, May 6, 1839, the son of Jacob and Margaret (Whittenburg) Easterly, both natives of Greene County, the former a farmer, born in 1802, and deceased in June, 1883. Jacob, Sr., the next ancestor, a Virginian, was a pioneer of Cocke County. The mother was born in 1803 and died in 1854, the daughter of William Whittenburg, of Greene County. Our subject was educated in Emory and Henry College, Virginia, and in 1864 began reading medicine under Dr. B. F. Bell, now of Cocke County. He began practice in 1866 in the county, and has continued eminently successful. He is an extensive farmer also, owning and cultivating 750 acres. May 24, 1866, Louise V., a daughter of David DeVault, of Greene County, became his wife. She was born April 10, 1844, in Greene County. Four of their six children are living. She died February 2. 1887, a member of the Methodist Episcopal Church, of which our subject is a local minister.

Mrs. J. B. Bell Dies In Local Hospital After Long Illness
Mrs. Mable Easterly Bell, aged 79, died in a local hospital this morning at 9:10 after a long illness.
She is survived by four sons, Esquire Frank Bell, a member of the Greene County Court, Robert Bell of Campbellville, Ky., Henry and Hubert Bell of Greene County, three daughters, Mrs. M. A. Baker of Homestead, Fla., Mrs. Lanty Ross of Maryville, and Mrs. Len Troutt of Knoxville and one brother, Mr. J. E. Easterly of this city. Several grandchildren also survive. Her husband, Dr. J. B. Bell, died several years ago.
The funeral will be held at Whittenburg Methodist Chruch Friday afternoon at 2:30 by the Rev. Cas. Turner and Rev. P. H. Horner and Rev. Wilbur Sauceman. Interment in Whittenburg Cemetery.
Mrs. Bell had been in failing health for some time, and her death was not unexpected.
She was a member of a prominent Greene County family, having been the daughter of the late Dr. Jacob Payne Easterly, and Mrs. Louise DeVault Easterly. Dr. Easterly was not only a physician but also a minister, and his home was the social center of his community.
She was a woman of great native intelligence and real literary and artistic ability. Her father, who was one of the highly skilled and greatly beloved Greene County doctors was a collector of books, and had a fine library, and from the time she was a little child, she browsed among these well read volumes, and read and re-read them. Later she attended Tusculum where she pursued her education.
The daughter of a doctor, she also married a doctor, and all her life had a part in the ministration of the art of healing to suffering humanity.
When quite young she became a member of Whittenburg Church, and from the time she identified herself with the faithful she became one of the ablest and best leaders working in the Sunday School, church orgainzations, and helping in every way to further the work of the organization.
Her splendid character and personality gave her unusual gifts as a leader, and during World War One, no woman in the county accomplished more for the Red Cross and other war activities, as she was able to organize and direct and get the co-operation of others.
Her childhood home was noted for its hospitality. So many visitors were constantly entertained there from far and near that two cooks were always employed in the kitchen to provide the meals, and when the daughter of the household moved into her own home she carried with her the tradition, and constantly entertained friends of her husband and children.
She was a real home maker and gave without restraint of her time and energy to her family, each one of whom, down to the last little grandchild found its own spot in her warm mother heart.
In the passing of Mrs. Bell, Greene County has lost one of the few remaining contacts with the past generation, and able and public spirited citizen whose place in her community cannot be filled.

FUNERAL RITES THIS AFTERNOON FOR DR. J. B. BELL
Prominent Greene County Physician Died Saturday At Bright Hope Home.
Dr. J. B. Bell, aged seventy-three, one of Greene County's outstanding physicians, died Saturday afternoon at one thirty at his home at Bright Hope.
Six weeks ago Dr. Bell suffered a fall, from which he never completely recovered.
He is survived by his wife, Mrs. Mabel Easterly Bell, three daughters, Mrs. M. A. Baker, of Homestead, Fla., Mrs. Nell Ross, of Maryville and Mrs. Virginia Trout of Knoxville; four sons, Frank Robert and Henry Bell of Greeneville and Herbert Bell of Seattle, Wash. He is also survived by three sisters, Mrs. Mell Stokely of Del Rio, Tenn., Mrs Clara Roberts of Talbotts' Tenn., and Mrs. Pinkney Wells, Leicester, N. C., and one brother, B. F. Bell of Fort Meade, Fla. four granddaughters and six grandsons.
Funeral was held at two o'clock this afternoon at Whittenburg church with the pastor, the Rev. J. F. Reed officiating. Interment was in adjoining cemetery.
Pallbearers were members of the Greene County Medical Society, Active included Drs. M. A. Blanton, W. T. Mathes, L. E. Coolidge, R. S. Cowles and L. E. Dyer. Also Mr. V. R. Bottomly.
Honorary included the remaining members of the medical society. Flower bearers were Misses Embree and Ruth Ellison, Mildred Keels [should be Mildred Nix], Gwendolyn, Louise and Mary Nannette Mathes, Evelyn Stokely; Marynell, Margaret and Betty Ross, Margaret Nelson, Mrs. Verna Mathes, Mrs. Ida Bell Nelson and Mrs. Frank Sokely.
Dr. Bell was a member of a prominent East Tennessee family, having been the son of the late Dr. Benjamin Franklin Bell, a very prominent and successful physician, and Mrs. Mary Bowers Bell. He was born at Parrottsville and received his academic education at Emory and Henry University and his medical training at Vanderbilt University in Nashville.
When quite young he was married to Miss Mabel Easterly of Greene County, and the young couple came to Warrensburg to live. Later they moved to the Bright Hope community, so Dr. Bell's forty-seven years of professional life have been spent in ministering to Greene County.
He lived the life of a typical country doctor, which meant that before the days of good roads and cars he rode countless miles on horseback answering the call of suffering humanity. No night was too dark and stormy for him to respond to the need of his fellows.
Yesterday among the numbers who stood by his bier weeping were men in torn overalls and ragged shoes, blessing the good doctor as "the poor man's friend" and those of high degree, both equally impressed with a sense of great loss.
Mr. Bell was recognized as an outstanding man in his profession, and several times served as president of the Greene County Medical Society. During the World war he was on the County board of examiners and has taken a leading place among the medical men of the county and state.
Though a very busy man, he found time to be very much interested in politics, and for twelve years served as a member of the Greene County Court, a position which his son, Esq. Frank Bell follows him. He was a constructive influence in the court, and was quite a power in shaping county affairs. He was a man of very decided views and was able to defend them.
Dr. Bell was deeply devoted to his church. For many years he was a pillar in the Whittenburg Church, and could be counted on to take the lead financially and otherwise in its support. At the time of his death he was a member of the board of trustees of the church.
He carried the Christian principles in which he believed so devoutly into his daily life, and for many years his large family was gathered around the family altar each evening for family prayers which he led.
Like all conscientious doctors there was no limit to the charity he poured out on the poor and helpless, and for almost half a century he gave freely of his services, bringing healing to countless homes. Few citizens of the county have meant more to it.
Adored by his wife and family, respected and admired by members of his profession, and his church, deeply loved by his patients, the passing of Dr. Bell is a great loss, not only to the intimate circle of which he was the center, but to Greene County as a whole.

Mrs. W. B. Ellison
Mrs. William B. Ellison died at the Greeneville hospital Sunday night at 9 o’clock, after lingering for several days between life and death. Mrs. Ellison was brought to the local hospital from Johnson City about ten days ago for an operation. She seemed to have recovered from the operation and her condition was not considered dangerous until a short time before her death. She is survived by her husband and four small children, two brothers and two sisters, who reside in Greene county. She was a daughter of the late Dr. J. P. Easterly of Little Chuckey, and had many friends in that section who will regret to hear of her death. Her remains were taken to her old home near Bright Hope Monday afternoon. Interment took place in the community cemetery near by on Tuesday.

Note: Lula's obituary lists a yet-unaccounted-for sister.

He was a son of the late Dr. Jacob Payne Easterly and Virginia Louise DeVault Easterly.
He was a prominent livestock dealer and farmer and a lifeling member of the Whittenburg Methodist Church.
The body was removed this afternoon at two o'clock from Kiser Funeral Home to the late home on Maple Avenur.
