She resided in Farm, Sullivan Co., Tennessee; after John died she moved in with her parents, Stone House A, Boon's Creek, Sullivan Co., Tennessee.7 She was enumerated on the census in Washington County, Tennessee (1860 - 1880.) She was a Farmer (1860.)3 When Betsy's husband died, she and her four children moved back to Stone House "A" to live with her parents. When her mom died, her dad deeded Stone House "A" and surrounding lands to Betsy. She continued to live there until 1880 when she moved with her son, Martin Van Buren DeVault and his family to a new frame house about 600 yards east of Stone House "A".

OCT. 9, 1890. John and Elizabeth lived near Piney Flats in Sullivan County on a tract of land that belonged to his father. The land was willed to John when his father died in 1842. They lived on this farm until John's death in 1851, the same year their last child was born. Some time later his widow Elizabeth and her four small children went to live with her parents. They all lived in Stone House "A" on Boon's Creek.
Elizabeth's mother died on June 9, 1856 and in October of that year her father deeded the farm and home to her. Elizabeth died in 1899. She left the old "Kitzmiller" home to her son, Martin. He sold it in 1906.

TRAGEDY STRIKES THE FAMILY OF MARTIN KITZMILLER, JR
Martin Kitzmiller, Jr. first married on September 22, 1828 in Carter County, Tennessee. His wife was Rebecca Duncan and the couple had three children: Abdiel, Joseph and Mary. The first of a series of tragedies to strike the family of Martin Jr. was in 1836 when Rebecca died. Martin Jr. was left with three small children to care for. On October 5, 1837 he married his double cousin, Elizabeth Christina Davault the daughter of Jacob and Rachel (Kitzmiller) Davault. The next tragedy occurred on April 27, 1847, when Joseph, the second child of his first marriage, died. By now Martin and Elizabeth had seven children of their own. Their names were: James, Jacob, John, Rebecca, Susan, Margaret and Martin III. In December of 1850 the family moved to Macoupin County, Illinois. They were part of a large migration of families from east Tennessee to Illinois. This migration included four of Elizabeth's brothers and sisters. Martin and Elizabeth's last child, Rufus, the only child to be born in Illinois, died at birth on March 25, 1853. Then, on July 1, 1854, Martin himself died.
The series of tragedies was not over with Martin Jr.'s death. Tragedy struck three times in 1859: On November 4th his son Jacob died, a month later on December 14th his daughter Rebecca died and eight days later, on December 24th his daughter Susan died. In 1862 two more sons died: Abdiel on April 4th and James on April 23rd. By 1870, out of a family of three adults and 11 children, only Martin's second wife, Elizabeth and three of her children were still living. They were John, Margaret, Martin III. In 1873 daughter Margaret married Benjamin F. Scott. He died on September 23, 1879, and, two months later, on December 18th, Margaret's mother died.
Sometime after 1880, unmarried brothers John and Martin III and widowed sister Margaret with her two small children moved to Bates County, Missouri. John and Martin III never did marry. Of the two children of Margaret (Kitzmiller) Scott, son James Ralph Scott married but had no children and daughter Euphia Scott, never married.
Based on the information that Newland had at the time he prepared his report, he believed that there were no living descendants of Martin Jr. New information has shown this to be incorrect. Newland had assumed that Abdiel and Mary, the two children from Martin Jr.'s first marriage that were still alive in 1850, had accompanied the family to Illinois. He reported that Abdiel died, unmarried, on April 4th, 1862 in Macoupin County, Illinois. I suspect that Abdiel did not accompany the family to Illinois in 1850. I do know that he was in Tennessee on January 30, 1855, for on that day he married Mary Jane Taylor. After their first child was born, Abdiel and family moved to Illinois where a second child was born. Next they moved to Gentry County, Missouri where a third and fourth child were born. Finally, they moved back to Macoupin County, Illinois where Abdiel died in 1862. (After Abdiel's death, his wife and children moved back to Tennessee.) This marriage of Abdiel Kitzmiller to Mary Jane Taylor, although unknown to Newland, produced children whose descendants are alive today (2004).
As for Mary, the daughter from Martin Jr.'s first marriage, Newland says that she traveled with her father and step-mother to Macoupin County, Illinois. He goes on to say that Mary, also having never married, stayed with the family and eventually moved with her half-sister and two half-brothers to Bates County, Missouri. I have not found any evidence to suggest that Mary ever left Tennessee. In fact, she seems to have completely disappeared after the 1850 Census in Washington County, Tennessee. From the following chart it can be seen that Martin Kitzmiller, Jr. and his second wife, Elizabeth Christina DeVault had, no in-laws, only aunts and uncles:

JAMES HUGHES is a true son of the soil and has been a practical farmer all his life. He has attained in his chosen occupation a degree of success which is the result of expert knowledge and long, practical experience. He was born in Tennessee, April 19, 1827, a son of Robert and Elizabeth (Daybolt) Hughes the former a native of Tennessee and the latter of Pennsylvania.
James Hughes is the only surviving member of a family of five children. He received his early education in the common schools of Tennessee and worked upon his father's farm until he was twenty-seven years old, gaining an expert knowledge of the various details connected with the pursuit of agriculture. He left home at the age of twenty-seven and was engaged in farm work in his native state until 1873, when he sold out and came to Marion county, Oregon, where he remained for two years. At the end of that time he removed to Washington and engaged in farming in that state. His holdings there amounted to four hundred acres, which he operated and developed with great success for four years. At the end of this time he sold his farm in Washington and bought four hundred acres in Benton county, where he worked for three years. He sold out at the expiration of that period and bought a farm in Douglas county, upon which he now resides. His present holdings amount to one hundred and eighty acres of well cultivated farm land. He has made extensive improvements, has added to his stock, erected new barns and outbuildings and modernized his equipment. He is now the owner of one of the model farms of Douglas county.
On September 3, 1854, Mr. Hughes was united in marriage to Miss Elizabeth Kitzmiller, a native of Tennessee, and they are the parents of four children: Louisa, who died in infancy and is buried in Tennessee; and John R., David and George W., all of whom are living at home. Mr. Hughes is a consistent republican in his political affiliations and held the office of postmaster of Piney Flats, Sullivan county, Tennessee, when he was farming in that district. The farm upon which he now resides is thoroughly equipped and modern in every detail and through the energy and resourcefulness of Mr. Hughes has become one of the most valuable ranches in Douglas county.
OBITUARY
OLD SETTLER PASSES AWAY AT CANYONVILLE HOME
Canyonville, Or., Dec. 16. -- One of Oregon's oldest settlers, James Hughes, who was born in Tennessee, April 19, 1827, is dead here. He married Elizabeth Ketchmiller (sic) September 7, 1855, and came to Oregon in 1877, settling near Salem. Later he moved to Walla Walla where he lived for five years, then he went to Corvallis and for the last 31 years he has lived at Canyonville, where he died yesterday. Three sons were at his beadside, John, David and George.
Note: I did not find a stone for James Robert Hughes in the Canyonville I. O. O. F. Cemetery.

United States Bankruptcy Court, E.D. Tennessee, June 15, 1989. In re Charles Pender EDWARDS, III, C.P. "Bud" Edwards, "Bud" Edwards, Debtor. Charlyne E. HADEN, Plaintiff, v. C.P. EDWARDS, III and Fifth Third Bank, Defendants. RICHARD STAIR, Jr., Bankruptcy Judge.
This matter is before the court on a "Motion To Dismiss" filed April 14, 1989, by the defendant Fifth Third Bank (Bank). The Bank seeks a dismissal of Plaintiff's claims against it pursuant to Fed.R.Civ.P. 12(b)(1) and (2), incorporated into Fed.R. Bankr.P. 7012(b), averring that the bankruptcy court lacks subject matter and personal jurisdiction. For reasons discussed infra, the court has determined that Counts I through VII in Plaintiff's complaint, asserting causes of action against the Bank, are "related" to the bankruptcy case. Consequently, this court has jurisdiction to hear and adjudicate Plaintiff's claims against the Bank consistent with the procedures dictated by 28 U.S.C.A. § 157(c) (West Supp.1989).
I) Charlyne E. Haden (Plaintiff or Haden) initiated this adversary proceeding with the filing of a complaint on February 15, 1989. She alleges that she and the debtor are two of the three children of C.P. Edwards, Jr. (Edwards); that Edwards, a successful businessman, established profitable business ventures in many fields, including insurance, publishing and real estate; that by the 1950s he had established some twenty (20) corporations to carry on his business interests; and that Edwards made his three children majority shareholders in thirteen (13) of these corporations referred to in the Complaint as the "Children's Companies."
Haden further alleges that in the mid 1960s, the debtor began to manage "the Companies"; that she entrusted the management of her interests in "the Companies" to Edwards and the debtor; and that the debtor later occupied the positions of shareholder, officer and director in many of "the Companies."
Haden further alleges that starting in approximately 1962, a number of "the Companies" began to borrow funds from the Bank; that all assets of "the Companies" were pledged as collateral to secure the Bank's loans; that without her knowledge, the loans were cross collateralized; and that she was not aware of the details concerning the relationship between the Bank and "the Companies."
Haden's Complaint is grounded upon eight (8) separate counts: seven (7) assert causes of action against the Bank; one (1) asserts a cause of action against the debtor. In general, the Plaintiff outlines a course of dealings which she alleges evince joint conduct on the part of the Bank and the debtor to enrich themselves to her detriment and to the detriment of "the Companies."
Count I of Haden's complaint alleges an agreement between the three Edwards children, the Bank and a third party under which the third party was to pay $550,000 to the Bank in satisfaction of the Bank's loans to "the Companies." In exchange, the collateral pledged to the Bank was to be released to the three children. Haden avers that most of the collateral was improperly released by the Bank directly to the debtor; that this was accomplished without her knowledge or consent; that the Bank and the debtor concealed from her the release of the collateral; that she has received none of the collateral despite her ownership interest in "the Companies"; and that the Bank and debtor have refused to provide her with explanations concerning the status of the collateral. Haden avers that the Bank's conduct constitutes fraud, negligent misrepresentation, breach of contract and negligence.
The second count of Plaintiff's complaint avers an agreement between the Bank and debtor to sell certain collateral and to divide the sale proceeds equally. According to the complaint, assets of "the Companies" exceeding $2,000,000 in value were sold, the proceeds divided between the Bank and debtor, with no portion of the sales proceeds credited to the Bank's loans to "the Companies."
In the third count of her complaint, Plaintiff alleges a complicated series of transfers of real property from two corporations, one of the "Edwards Companies" and one of the "Children's Companies," to a corporation owned by the Bank. Haden contends these transfers took place without any credit or reduction in the Bank's loans to "the Companies."
Count IV relates to one of the "Children's Companies," Bald Mountain Development Corporation (Bald Mountain). Plaintiff avers that an outside corporation, Dynamic Systems, Inc. (Dynamic), acquired an 80% interest in Bald Mountain; that the Bank owned and controlled Dynamic; that as a result of its acquisition of Bald Mountain, Dynamic became liable to the Bank on a $502,200 Bald Mountain debt; that the Bank did not release Dynamic from this obligation; that the loan apparently went into default; and that the Bank foreclosed upon some of the collateral pledged by "the Companies." Haden further alleges that the Bank did not apply the proceeds from the foreclosed collateral to the loans owed by "the Companies."
In her fifth count, Haden avers that the Bank allowed the debtor to transfer real property collateralizing the Bank's loans owned by Bald Mountain to Wolf Laurel Properties, a corporation whose majority owner was the debtor; that this transfer occurred without Haden's knowledge or consent; that the Bank removed these assets as collateral for its loans to "the Companies"; and that the Bank failed to properly credit or reduce the loans by the value of the real property transferred.
In Count VI of her complaint, Haden alleges that the debtor transferred part of the Bank's collateral, real estate known as Swim Halle, to himself for inadequate consideration. According to the complaint, the debtor then conveyed Swim Halle to Bald Mountain in satisfaction of a debt owing Bald Mountain. After Bald Mountain was acquired by Dynamic, Bald Mountain conveyed Swim Halle back to the debtor. Haden asserts that the Bank consented to these transfers. As a result, Haden claims that Swim Halle was not available to be credited toward the Bank's loans nor was it available for distribution to Plaintiff upon payment of these loans.
Plaintiff's seventh count, entitled "General Dealings," incorporates the previous counts as follows:
[The Bank's] conduct . . . demonstrates a pattern of failing to properly credit family debts, self-dealing in family collateral, usurping in violation of its fiduciary duties the corporate opportunities of the Children's Companies and Edwards Companies and transferring for no or inadequate consideration family assets.
On the basis of these and other averments, Haden seeks an accounting of the Bank's transactions with the debtor, "the Companies," and any companies or businesses in which the debtor holds an interest.
In the eighth and final count of her complaint, Haden objects to the debtor's discharge on grounds premised upon 11 U.S.C.A. § 727(a)(3), (4) and (5) (West Supp. 1989).
Haden, in her prayer for relief, seeks a judgment against the Bank for compensatory and punitive damages in the amounts of $10,000,000 each; that Haden's claim against the debtor be established in the amount of $10,000,000; a judgment denying the debtor's discharge, or, alternatively, a determination that her claim against the debtor is excepted from discharge; and a jury trial on all issues raised in her complaint.
The debtor filed his answer to the Complaint on May 5, 1989. He does not challenge the jurisdiction of the court to hear this adversary proceeding.
II) Haden, in compliance with the pleading requirements of Fed.R.Bankr.P. 7008(a), avers in her complaint that this adversary proceeding is a core proceeding. Apparently foreseeing the possibility that the court will find her claims against the Bank to be noncore, she also avers that she "consents to the entry of final orders by this Court." At a hearing held May 17, 1989, on the Bank's "Motion To Dismiss," counsel for Haden conceded that her claims against the Bank are not core proceedings. She contends, however, in reliance upon Kelley v. Nodine (In re Salem Mortgage Co.), 783 F.2d 626 (6th Cir.1986), that her claims against the Bank are "related" to the bankruptcy case in that resolution of these claims "will impact the handling and administration of this case." Mrs. Charlyne (Ben) Haden, 83, of Chattanooga, died Sunday, May 10, 2009, at her home. Her death followed a lengthy illness.
She is survived by her husband, Ben Haden; her daughter, Dallas Haden Gibbons; her son-in-law, Arthur Gibbons; her granddaughter, Haden Gibbons; and a brother, C.P. Edwards.
Charlyne was a native of Kingsport, Tenn. She finished at Ward-Belmont Preparatory School in Nashville. She graduated from Finch College in New York City after attending Sophie Newcomb in New Orleans. She also attended the New York School of Design, where she studied interior decoration and dress design.
She was a Harry Conover Model in New York, appearing in Harper’s Bazaar and Town & Country Magazines. She was a portrait and landscape painter with exhibitions in Chattanooga, Atlanta, and Nantucket, Mass. Her work is included in numerous corporate collections as well as TVA and U.S. Navy.
Charlyne was a believer in Jesus Christ and a member of First Presbyterian Church.
She was a member of Junior League of Chattanooga, Junior League Garden Club and the Chattanooga Golf and Country Club.
A memorial service will be held at 11 a.m. Thursday, May 14, at First Presbyterian Church with John Queen and Ben Haden officiating.
After the services, the family will receive friends in the Fellowship Hall of the church.

Mrs. J. Guy (Ethel) Carter, 87, Rt. 14, died Sunday morning in Colonial Hill Nursing Home following a lengthy illness.
She was a life-long resident of Washington County and was the daughter of the late Alexander and Victoria Hodges Henley.
She was a retired farmer and was a member of the Boones Creek Church of Christ.
She was preceded in death by her husband, Judson Guy Carter, in 1950.
Survivors include a son, Ernest Carter, Johnson City; a daughter, Mrs. Stanley L. Harrison, Kingsport; two grandsons; several nieces and nephews.

Mrs. Eleanor V. Kitzmiller was born Nov. 11, 1844, died at her old home Dec. 12, 1921, aged 77 years, one month and two days.
She is the daughter of Nathan W. Bachman, who was one of the pioneers of this section, and one of the first of a family which has been God fearing, and an example of good citizenship.
Shortly after the Civil War she was married to Dr. Richard Carr Kitzmiller who died two years ago this month.
Mrs. Kitzmiller is survived by a daughter, Mrs. Mary K. Osborne, widow of the late Rev. William E. Osborne, who served the Jonesboro Baptist Church faithfully and efficiently as pastor at one time. Other surviving relatives are the grand children, Eleanor Osborne, now a senior student at the Florida State Women's College, and John Alden Osborne who is attending the University of Florida. A brother, E. H. Bachman of Kingsport, survives her. She was a sister of the late Mrs. J. D. Cox, Sr., of Jonesboro.
With her husband she was a life member of Buffalo Ridge Baptist Church in whose membership she lived faithfully through her long years, "serving her day and generation by the will of God." Her goodness and generosity is known throughout this section and many will rise up and call her blessed. Like Mary of the olden time, "she hath done what she could." How beautiful to have lived a life like this rather than one for selfish interests, and to have met the approbation of the Master who has already said to her, "Well done thou good and faithful servant, enter thou into the joys of thy Lord."
Funeral services were held at the grave by Rev. W. N. Rose assisted by Rev. Hale S. Hamilton Wednesday, Dec. 14th, 1:30 p.m. and the body laid to rest in the old Jonesboro cemetery by the side of her husband to await a glorious resurrection.
Note: The above obituary says that Mary (Kitzmiller) Osborne's husband once served as the pastor of Jonesborough Baptist Church. I think this is an error. I do not think William Henry Osborne ever even lived in Jonesborough.

Jonesboro Men Buy Ridgefields Farm's Registered Aberdeen - Angus Cattle Herd
The entire herd of registered Aberdeen-Angus cattle, consisting of over 100 head, has been sold by C. P. Edwards, Jr. owner of Ridgefields Farm of Kingsport, for an undisclosed amount to Keefauver Brothers of Jonesboro, according to an announcement yesterday.
The sale is reported to be one of the largest transactions of pure bred beef cattle made in this section for some time. The reason for the sale was the fact that several hundred acres of Ridgefields Farm are now being divided into a real estate development, golf course and country club. The herd will remain at Ridgefields Farm probably until next spring.
Started in 1942
This herd was started in 1942 and represents some of the best cattle selected from the leading Angus breeders, such as Hardwicks Farm, Tolan, French Broad Farms, Macmor Farms, and other leading farms. Whenever the Ridgefields Farm cattle have been offered for sale, they consistently sold with the top cattle, and when shown, they have won many blue ribbons.
The Keefauver Brothers Farm, owned by Joe and Jack Keefauver, is located in the Boone's Creek community. Their herd of Angus is well known throughout the Southeast, having been founded from the top animals from Hardwicks Farm. They had the Supreme Champion Female at the Southeastern Sale and just recently had the Grand Champion Female at the Southeastern World's Fair. They have also recently sold cattle into the states of Georgia, Michigan, Montana and Tennessee.
Leading Herds
They have several sons and daughters of the last year's International Grand Champion Eileenmere 500 and with the addition of the leading Ridgefields Farm cattle, it will give them one of the leading herds of Aberdeen-Angus cattle in the entire Southeast.
Mr. Edwards plans to continue to operate the remainder of the farm with commercial cattle.
Joe Keefauver will continue as manager of Ridgefields Farm. He has been connected with them since May, 1946, having formerly been manager of the Hardwicks Farm of Cleveland, Tenn.
Note: I doubt that they knew this at the time but the wife of C.P. Edwards, Jr. and the Keefauver brothers were fourth cousins.

Charles P. Edwards, Jr., who died Wednesday after a long illness, was an example of the classic American success story. In the Horacio Alger tradition, he rose from a modest beginning to accumulate wealth and power, and played a major role in building the city that Kingsport is today.
Part of his success could be attributed to being in the right place at the right time. He started a small insurance business on borrowed money in a young city that was destined to grow rapidly and he grew with it. But luck alone could not have accounted for the success he achieved. The main ingredient was the astute business sense that he exhibited throughout his active career.
C. P. Edwards, Jr. was not one of those back-slapping, glad-handing live-wire types of businessman. He usually preferred to stay in the background.
Although Edwards was a significant part of the 'brains" behind many successful business and civic enterprises, you won't find his name on parks, streets or public buildings. A long-gone former partner took top billing even on the one firm name that carries his name, Bennett and Edwards.
After illness had already removed him from active life and given the reins to others, the city did name a bridge for him, a bridge that provides access to one of the city's leading residential areas which Edwards planned and developed. Most people still just call it the "Ridgefields Bridge."
C. P. Edwards is now gone, but we believe the tradition of keen decision-making, integrity and public mindedness he handed down still exists and will assure the continued growth of the city on which he has left an indelible record.

Business Leader C. P. Edwards Dies
Prominent Kingsport businessman C. P. Edwards, Jr. who formerly headed Kingsport newspapers, a radio station, and helped found a savings and loan company and an insurance firm, died this morning at 6:15 at Wilcox Hall following a long illness. He was 78 and made his home at 2105 Pendragon Road.
Born Charles Pender Edwards, Jr., August 2, 1896 in Flag Pond, Tenn., he was the son of Dr. C. P. Edwards and Valeria Bailey Edwards.
He attended Hotchkiss Preparatory School, Lakeville, Conn., and Carson-Newman College in Jefferson City, Tennessee.
Serving with the French army as an ambulance driver, Edwards was discharged and joined the American Army when the troops were sent abroad.
Following World War I, he came to Kingsport and married Flora Jane Massengill of Piney Flats, Tenn., in December, 1910 [sic 1920].
For a while, he worked at Grant Leather Corporation for $35 a month. But disliking the stench of the leather tannery, he took a correspondence course on insurance and decided to go into business for himself.
He set up his office -- on borrowed capital on a borrowed desk -- over the Kingsport Drug Company at the corner of Main and Broad Streets.
Across the street from Edwards' office was the Bennett and White Insurance Agency, located in the Old Bank of Kingsport building.
Edwards bought White's interest in 1921, moved across the street, and the Bennett and Edwards Agency was born. Two years later, Edwards purchased Bennett's half of the business and later moved into the business's present 214 Commerce St. address in 1955.
Edwards was one of the founders of Kingsport Federal Savings and Loan Association in 1930 and served as chairman of the board until his retirement last year.
He was also owner and one of the organizers of the Kingsport Broadcasting Corporation in 1940, and served as president until he sold the radio station in 19_6. [may be 1966 - cac]
He was a director and officer of the first National Bank of Sullivan County for many years. Elected to the board of directors in 1930, he was elected vice-president to succeed the late E. W. Palmer in 1939, and was named chairman of the board in 1948, serving until his retirement in 1965.
Purchasing the Kingsport Publishing Corporation in 1938, Edwards was president and publisher until he sold the company in 1962.
Edwards was a past member of the Executive Committee of Hoston Valley Community Hospital, coordinator of civilian defense in the Kingsport area during World War II, a member and past commander of the American Legion of Kingsport, founder of Kingsport Development Co., forerunner of the Chamber of Commerce, charter member and honorary member of the Kiwanis Club of Kingsport, member of the Veterans of Foreign Wars, Kingsport Masonic Lodge No. 688 and a member of St. Paul's Episcopal Church.
He was presented the American Legion Distinguished Service Award in 1968.
Survivors include his widow, Mrs. C. P. Edwards, Jr. of the home, two daughters, Mrs. Allen (Betsy) Exum of Kingsport; Mrs. Ben (Charlyne) Haden of Chattanooga, Tenn.; one son, C. P, (Bud) Edwards III of Kingsport; four sisters, Mrs. Linsay (Isabelle) Johnson of Catersville, Ga., Mrs. Robert (Lucy) Adams of Knoxville, Mrs. W. B. (Irene) Greene and Mrs. Wiley (Helen) Weaver, both of Kingsport; three brothers, James Edwards, L. L. Edwards and Val Edwards, all of Kingsport; six grandchildren and one great-grandchild.

Berndt and Dr. Ben Haden officiating. Friday, Mr. Berndt will celebrate a Requiem Holly Communion at the Church at 9 a.m. Burial will be in Oak Hill Cemetery. Military grave side services will be conducted by American Legion Hammond Post No. 3. The body will remain at the funeral home where the family will receive friends Thursday from 7 to 9 p.m. The family suggests that those who desire may make contributions to Wilcox Memorial Fund at Holston Valley Community hospital. BASIC FACTS
James H. "Jimmie" Hodges was born on 26 October 1802 in Boone's Creek, Washington Co., Tennessee.8 He was born in 1803.9 He was born in 1808 in Washington Co., Tennessee.10 He and Mary "Polly" Kitzmiller were married on 25 August 1825 in Washington Co., Tennessee.1 He died on 11 June 1888, at age 85, in Washington Co., Tennessee.11 He died on 20 June 1888, at age 85, in Washington Co., Tennessee.12 He died on 11 September 1888, at age 85.13,14 He died in 1894, at age ~92.1 He was buried in Hodges Cemetery, Boone's Creek, Washington County, Tennessee (V), Allison/Boring.11 James H. "Jimmie" Hodges was also known as James Hodge.15,13 He was a Farmer (1850 - 1870, 1880.)4,5,7 He was enumerated on the census in Washington Co., Tennessee (1850 - 1870, 1880.) In the 1880 Census shows a Mack Houston living with the family. Also in the 1880 Census is a Sue Houston, listed as an adopted daughter, living with James' son Canada/Kennedy Hodges. I suspect that the two Houston children are related.
WILL OF JAMES H. HODGES
14 January 1881 , Tennessee
I, James Hodges of Washington County, Tennessee do make and publish this my Last Will and Testament, hearby revoking and making void any and all other Wills made by me at any other time.
1st: I wish to be buried in a decent and plain manner and to have respectable, but not costly tombstone put at my grave, and direct my excutors to pay my burial expenses out of the first money that may come into their hands; and to purchase, erect, and pay for the tombstone within a reasonable time after my death.
2nd: My executors, next after paying my burial expenses, will pay all of my just debts out of any money that may come into their hands.
3rd: I will and bequeath to my beloved wife, Mary, all of my household and kitchen furniture including beds and bedding and tableware---every kind of property in the house and kitchen to have the same absolutely.
4th: I direct my executors to sell at public sale, in the event of my death before that of my beloved wife, enough of my personal property outside of dwelling--house and kitchen---to pay for all expenses necessary for my burial, the purchase of tombstone and the costs of probating this will and qualifying as executors and all the residue of my personal property of every kind I give to my beloved wife, Mary, absolutely. The said property, sold to pay burial expenses, for tombstones, and to pay administration expenses, as above stated will be sold on six months time as to all sums under five dollars. Should I survive my beloved wife, then my personal property will be disposed of as herein after stated.
5th: Should my beloved wife survive me, it is my will and desire, and I so direct, that so long as she remains my widow, she is to have the full use and control of the house and farm in and on which we live, to rent or cultivate the same and to have absolutely all rents and profits thus accruing.
6th: If I survive my beloved wife, then it is my will that all my beds and bedding, cupboard of tableware, my books and pictures framed, go to my four daughters, to wit, Elizabeth Smith, Susan Cox, Hannah White and Louisa Kidwell, they to divide the property among themselves, as they deem proper, or if they can not agree as to a division, then the executor of this Will will sell the said property and divide the proceeds of sale among them equally; and as to all other household and kitchen furniture, my excutors will sell it and divide the proceeds among my said four daughters, Elizabeth, Susan, Hannah, and Louisa.
7th: After the death of my beloved wife, or at the termination of her widowhood, or if I survive her, then as soon after my death as practicable, my executors are directed to advertise and sell publicly my farm on which I live and sell the same on six, twelve, and eighteen months time, and the money arising from said sale will be appropriated in the payments of certain legacies herein after mentioned, and said land will first be offered in two parts, and then as a whole, and the executors will adopt whichever realizes the most money.
8th: If I survive my beloved wife, then as soon after my death as practicable, my executors will sell all of my personable property, outside of dwelling house and kitchen and after paying burial expenses for the tombstone and administration costs, the residue will go into, and constitiute a part of the general fund out of which to pay legacies herein after mentioned and such sale will be for cash in hand for all sales under five dollars, and for all sales amounting to five dollars or more on twelve months time.
9th: I will to each of my four daughters, to wit, Elizabeth Smith, Susan Cox, Hannah White, and Louisa Kidwell, the sum of five hundred dollars (500.00) to be paid to them by my executors and this is to be in addition to what is condtionally given them under the 6th clause of the Will.
10th: I Will to my grandson, Joseph K. Hodges, the only child of my deceased son, Joseph, the sum of four hundred dollars (400.00) to be paid to him by my executors; and a like sum of four hundred dollars to my granddaughter, Mary Hodges, the only child of my deceased son, John, to be paid to her by my executors.
11th: The legacies set out in the 9th and 10th clause of this Will will fall due the said legatees respectively as follows: one-third of each legacy on the day the first payment on the land to be sold by the executors falls due; one-third of each legacy when the second payment on said sale notes falls due, and the remainder of each legacy is to fall due on the day the last sale note falls due. The reason why I am giving to my said four daughters and two grandchildren, Joseph K. Hodges and Mary Hodges, so much is that I have never given them but little, and it requires what is herein given them to make them equal with my other children to wit: Martin, Henry, Kenedy, Rolen and Mary Range, to whom I made advances years ago.
12th: If, after paying the legacies set forth in clauses 9 and 10 of this Will, there is a residue, said residue will be divided equally among all of my children, my said grandson, Joseph K. Hodges representing his deceased father and taking one share of said residure and my said granddaughter, Mary Hodges, representing her father, and taking one eleventh of said residue.
13th: Lastly, I hearby nominate and appoint a Executors of this Will my sons in law, Richard Kidwell and Landon White, and request them to accept the trust. Signed on this 14th day of January, 1881 in the presence of Witnesses, A.G. Pickens and E.C. Reeves.

85Y 7M 16D. He had reference number 675. Newland DeVault, in his report, lists a James M. Hodges (1827-1892) as the first child of Jimmie and Polly Hodges. It appears from the information that Newland provided that this is really Joseph M. Hodges, son of Edmond Hodges and Sarah McCroskey. Missing from Newland's list of children is John Kitzmiller Hodges. Several genealogies list John Kitzmiller Hodges as the first child of Jimmie and Polly Hodges. Newland also lists a son, Richard, born in 1838. So far I have not found any corroborating evidence. This includes the 1840 Census that matches the males correctly without Richard. I have deleted Richard from the list.
Apparently Jimmie and Polly had two daughters named Hannah. The first only lived a couple of years and is buried at the Allison-Boring-Hodges Cemetery. The second Hannah was the first child born after the first Hannah died.
