NEWSPAPER ARTICLE - Alexandria Gazette (Alexandria, VA), October 16, 1872, page 2
ESTATE OF THE LATE ALEXANDER LORMAN
In the Circuit Court for Baltimore city, Judge Pinkney, a bill was filed Thursday by Edward Otis Hinkley, esq., counsel for Edward Roberts and Dr. John H. Patterson, trustees, under the will of Alexander H. Lorman, for the settlement of their trusts. Mr. Lorman left an estate worth over a million dollars, and after devoting a large portion of it to public charities and some specific legacies, gave one-half of the rest to the six children of his late uncle, William Fulford, of Harford county, namely Eleanor, Elizabeth Averilla, Sally, Henry and Alexander L., being the maternal cousins of the testator, for their lives respectively, and then to their children. He gave the other half to the children of his aunt, Ann Chancellor, widow of the late George Chancellor, of Spotsylvania county Va., for their lives respectively, and then to their children. From the number of the cousins, there being six of the Fulfords and ten of the Chancellors, there are in the next generation a very large number of persons entitled, so that there are ninety-four persons named as defendants in the bill, comprising all persons now living who are interested in the estate.
The trustees have filed a report for a division of the real estate, (embracing only the fee-simple,) being a little over two hundred thousand dollars, and the personal estate yet remains in the hands of the executors, Francis T. King and Edward Roberts, and in due time will be handed over to the trustees. The trustees state that they have sold the old mansion and lot corner to the Central Savings Bank of Baltimore for fifty thousand dollars. The bill is filed primarily for division of Mr. Lorman's estate, but the complainants say also that at the foot of any order or decree for division they will ask for a settlement of all their trusts, to save the trouble and expense of new bills for that purpose, the parties being very numerous. An estate of such magnitude, and embracing so many parties, rarely comes into court for settlement. - Baltimore Sun.

Death of a Pioneer Railroad Man.
Mr. John Perkins of this town received a telegram on Friday morning informing him of the death of his father-in-law, Mr. William Roberts which occurred at his home in Philadelphia about ten o'clock on Thursday night. Mr. Roberts who was one of the oldest railroad men in the country, was just entering his 80th year, having been born on the 14th of February 1812. He was a native of Frederick county, Md, of which county his wife who was Miss Rigney was also a native. When quite a young man he entered the U. S. mail service, then carried by stages from Baltimore to Wheeling, and afterwards entered the service of the B. & O. railroad, being the driver of the first car drawn by horses, from Baltimore to Ellicott Mills, as well as conductor of the first car after the application of steam. About the year 1850 he entered the service of the P., W. & B. railroad company, in which he remained until his retirement from active business pursuits
some fifteen years ago. He enjoyed a wide circle of personal and business acquaintances, and was universally esteemed for his stern integrity and high character, a fact recognized by his company in retiring him upon full pay. Mr. Roberts was the father of twelve children, eight of whom are living, four daughters and four sons, his eldest daughter Virginia being Mrs. John Perkins, and who was with her father at his death.

Lydia S. DeWald1,2,3,4
F, #580, b. 6 April 1796, d. 14 April 1866
Parents
BASIC FACTS
Lydia S. DeWald was born on 4 April 1796 in York Co., Pennsylvania.1 She was born on 6 April 1796 in York Co., Pennsylvania.5,6 She and William Sanders were married on 21 September 1817.6 She died on 14 April 1866, at age 70, in Probably McDonough Co., Illinois.7,5,6 She was buried in Camp Creek Cemetery, McDonough Co., Illinois.8 She was buried in Good Hope Cemetery, Good Hope, McDonough Co., Illinois.9 Lydia S. DeWald had reference number 581. She resided in Lived in Beardstown, Cass Co., Illinois (bef. 1821); Bernadotte, Fulton Co., Illinois (bet 1840 - 1850.)1,7 She was enumerated on the census in Cass County, Illinois (1840); Fulton County, Illinois (1850, 1860.) Newland DeVault says that there is an entry in the baptismal records for Saint Matthew's Lutheran Church that says, "[Born 4 April 1796, Baptised, 10 August, 1796: Julia; Parents: Phillip Thebald and Catherine; Sponsor: Anna Marie Rustaborn." Newland said that this was the daughter that came to be known as Lydia. He suspected that her full name was Lydia Julia DeWald. When Lydia was about seven years old the family moved to Baltimore, Maryland. In 1810 her parents bought land in Hampshire County, Virginia (now West Virginia). They are shown there in the 1820, 1830 and 1840 Censuses. I expect that Lydia was married in Virginia and probably had at least some of her children there.
Newland goes on to say that Lydia married William Sanders and moved to near Cass County Illinois. He says they had seven children. (In his 1937 report, he gives this list of children: Mary, Margaret, Catherine, Elizabeth, Julia, William and James. This list may have come from the final (1846) settlement of Henry Dewald's estate.) Finally, Newland says that Lydia was listed as a widow in the 1846 (final) settlement of Henry Dewald's estate. At the time she was supposed to be living in Beardstown, Cass County, Illinois.
I found the following Census records for Bernadotte, Fulton Co., Illinois:
1850 Census, Town of Bernadotte, Fulton Co., Illinois, 11 Dec 1850, pages 130-131, lines 40-42 & 1-6, dwelling 75, family 82

William Saunders, age 25, male, farmer, born Illinois
Margaret Saunders, age 21, female, born Illinois
1860 Census, Bernadotte Twp., Fulton Co., Illinois, Bernadotte Post Office, page 227, lines 31-37, dwelling 1672 family 1620;
Anderson Pigg, age 54, male, born Kentucky, farmer
Mary Pigg, age 35, female, born Missouri
James Pigg, age 17, male, born Illinois, farmer
Lydia Pigg, age 15, female, born Illinois
Pamela J., age 12, female, born Illinois
Lewis P., age 7, male, born Illinois
Lydia Saunders, female, age 65, born Maryland
When I examine the Lydia Sanders shown in the 1850 Census record it seems highly likely that she is Lydia DeWald. Her name, age and birthplace are correct. Also, this Lydia is not listed with a husband which is consistent with her being a widow in 1846. There are a number of Pigg family genealogies on the Internet. They show that Anderson Pigg was first married to Elizabeth Beadles. The James W. Beadles listed in the census is surely a relative. Anderson Pigg's second marriage was to Mary Sanders (or Saunders). The Louisa Sanders shown in the census is probably Lydia's daughter although, her name does not appear in Newland's list. There is some question as to whether the William Sanders shown in this census is related to Lydia or that he is even a Sanders. One researcher thought his surname might be "Landers."
So now it becomes a little sticky. In the 1860 Census, Lydia is still living with her daughter and son-in-law. Her name is now spelled "Saunders" and she is listed as being born in Maryland. Although we know that Lydia was born in Pennsylvania, her parents did move to Maryland when she was about 7. The William Saunders shown living next to the Piggs in the 1860 census is probably Lydia's son.
Marriages of Fulton Co., Illinois 1824-1861 (Vol A-98, License #61) show Anderson Pigg married to Mary Saunders on June 9, 1842.
On our 2005 genealogy trip, Judy, our granddaughter, Katie, and I visited Randall Cemetery. There we found Anderson Pigg, his wife, Mary (Sanders) Pigg, and several of their children. We did not find a stone for Lydia (DeWald) Sanders. At the time I was certain that Lydia would be there. Randall Cemetery is very near the Pigg farm and was used by the Pigg family for years before Lydia died. Subsequent research has shown that in 1840 Lydia was a widow living in Beardstown, Cass County, Illinois. One possibility is that Lydia's husband died in Cass County, Illinois and was buried there. When Lydia died, she was buried next to her husband.
Note: Recent research shows that after the 1860 Census Lydia went to live with her daughter, Catherine (Sanders) Munson in McDonough County, Illinois. Lydia died in 1866 and is buried in Camp Creek Cemetery along with a number of members of Catherine's family. I still have not located the grave of Lydia's husband.
Note:There is a genealogy on the Internet puplished by Judi Goodwin. It says that Mary (Saunders) Pigg is the daughter of William G. and Lydia (Sisson) Saunders. This is incorrect. Examination of the Sisson family genealogy shows that William G. Sanders was born in 1810 (14 years after the Lydia (DeWald) Sanders was born. It goes on to say that his wife, Lydia Sisson was born about 1814 and that she lived and died in Rhode Island. I have tried to contact Judi but, so far, I have not received an answer.

I am done making hay but helping others. I put up 10 ton hay is good. Crops of all kinds is good with out it is oats. They were just moderate - I have not been down in Jasper only 3 or 4 times in the last 8 months but will go down in a day or two. The man that offered 1.25 for your mule was a mule buyer passing through. I have not saw him since last winter. Jes said the last time I saw him that the small one was just commencing to grow for while it was at west it got the scratches & I believe the distemper and got very poor, but Bill and Lamkins both want the oldest one & offers $100. I hear nothing more about them & if they can be sold. C west told me the amt of corn he got. I disremember I think it lacks a little of making full payment to Bell Becurn sold about 100 bus to fix house. The mules bother in Walt Jones place. I believe he has sold out & Chambers and Moody all out but old boby. Jes sold his place fare and square but the man went back. The land south of Jes is sold and being ploughed up. John Warfeld sold his. We will soon have the cars running to Golden. We can sit in the house and see the hands working on the road. You would hardly know this country it is improving so fast. About them sheep all I can say just now is that all wants sheep now. I think they can be had for $2 but would have to go to Polk Co or lawrence. So I will close till I write. If you want to know anything more write soon as I am going away after little.

United States Bankruptcy Court, E.D. Tennessee, June 15, 1989. In re Charles Pender EDWARDS, III, C.P. "Bud" Edwards, "Bud" Edwards, Debtor. Charlyne E. HADEN, Plaintiff, v. C.P. EDWARDS, III and Fifth Third Bank, Defendants. RICHARD STAIR, Jr., Bankruptcy Judge.
This matter is before the court on a "Motion To Dismiss" filed April 14, 1989, by the defendant Fifth Third Bank (Bank). The Bank seeks a dismissal of Plaintiff's claims against it pursuant to Fed.R.Civ.P. 12(b)(1) and (2), incorporated into Fed.R. Bankr.P. 7012(b), averring that the bankruptcy court lacks subject matter and personal jurisdiction. For reasons discussed infra, the court has determined that Counts I through VII in Plaintiff's complaint, asserting causes of action against the Bank, are "related" to the bankruptcy case. Consequently, this court has jurisdiction to hear and adjudicate Plaintiff's claims against the Bank consistent with the procedures dictated by 28 U.S.C.A. § 157(c) (West Supp.1989).
I) Charlyne E. Haden (Plaintiff or Haden) initiated this adversary proceeding with the filing of a complaint on February 15, 1989. She alleges that she and the debtor are two of the three children of C.P. Edwards, Jr. (Edwards); that Edwards, a successful businessman, established profitable business ventures in many fields, including insurance, publishing and real estate; that by the 1950s he had established some twenty (20) corporations to carry on his business interests; and that Edwards made his three children majority shareholders in thirteen (13) of these corporations referred to in the Complaint as the "Children's Companies."
Haden further alleges that in the mid 1960s, the debtor began to manage "the Companies"; that she entrusted the management of her interests in "the Companies" to Edwards and the debtor; and that the debtor later occupied the positions of shareholder, officer and director in many of "the Companies."
Haden further alleges that starting in approximately 1962, a number of "the Companies" began to borrow funds from the Bank; that all assets of "the Companies" were pledged as collateral to secure the Bank's loans; that without her knowledge, the loans were cross collateralized; and that she was not aware of the details concerning the relationship between the Bank and "the Companies."
Haden's Complaint is grounded upon eight (8) separate counts: seven (7) assert causes of action against the Bank; one (1) asserts a cause of action against the debtor. In general, the Plaintiff outlines a course of dealings which she alleges evince joint conduct on the part of the Bank and the debtor to enrich themselves to her detriment and to the detriment of "the Companies."
Count I of Haden's complaint alleges an agreement between the three Edwards children, the Bank and a third party under which the third party was to pay $550,000 to the Bank in satisfaction of the Bank's loans to "the Companies." In exchange, the collateral pledged to the Bank was to be released to the three children. Haden avers that most of the collateral was improperly released by the Bank directly to the debtor; that this was accomplished without her knowledge or consent; that the Bank and the debtor concealed from her the release of the collateral; that she has received none of the collateral despite her ownership interest in "the Companies"; and that the Bank and debtor have refused to provide her with explanations concerning the status of the collateral. Haden avers that the Bank's conduct constitutes fraud, negligent misrepresentation, breach of contract and negligence.
The second count of Plaintiff's complaint avers an agreement between the Bank and debtor to sell certain collateral and to divide the sale proceeds equally. According to the complaint, assets of "the Companies" exceeding $2,000,000 in value were sold, the proceeds divided between the Bank and debtor, with no portion of the sales proceeds credited to the Bank's loans to "the Companies."
In the third count of her complaint, Plaintiff alleges a complicated series of transfers of real property from two corporations, one of the "Edwards Companies" and one of the "Children's Companies," to a corporation owned by the Bank. Haden contends these transfers took place without any credit or reduction in the Bank's loans to "the Companies."
Count IV relates to one of the "Children's Companies," Bald Mountain Development Corporation (Bald Mountain). Plaintiff avers that an outside corporation, Dynamic Systems, Inc. (Dynamic), acquired an 80% interest in Bald Mountain; that the Bank owned and controlled Dynamic; that as a result of its acquisition of Bald Mountain, Dynamic became liable to the Bank on a $502,200 Bald Mountain debt; that the Bank did not release Dynamic from this obligation; that the loan apparently went into default; and that the Bank foreclosed upon some of the collateral pledged by "the Companies." Haden further alleges that the Bank did not apply the proceeds from the foreclosed collateral to the loans owed by "the Companies."
In her fifth count, Haden avers that the Bank allowed the debtor to transfer real property collateralizing the Bank's loans owned by Bald Mountain to Wolf Laurel Properties, a corporation whose majority owner was the debtor; that this transfer occurred without Haden's knowledge or consent; that the Bank removed these assets as collateral for its loans to "the Companies"; and that the Bank failed to properly credit or reduce the loans by the value of the real property transferred.
In Count VI of her complaint, Haden alleges that the debtor transferred part of the Bank's collateral, real estate known as Swim Halle, to himself for inadequate consideration. According to the complaint, the debtor then conveyed Swim Halle to Bald Mountain in satisfaction of a debt owing Bald Mountain. After Bald Mountain was acquired by Dynamic, Bald Mountain conveyed Swim Halle back to the debtor. Haden asserts that the Bank consented to these transfers. As a result, Haden claims that Swim Halle was not available to be credited toward the Bank's loans nor was it available for distribution to Plaintiff upon payment of these loans.
Plaintiff's seventh count, entitled "General Dealings," incorporates the previous counts as follows:
[The Bank's] conduct . . . demonstrates a pattern of failing to properly credit family debts, self-dealing in family collateral, usurping in violation of its fiduciary duties the corporate opportunities of the Children's Companies and Edwards Companies and transferring for no or inadequate consideration family assets.
On the basis of these and other averments, Haden seeks an accounting of the Bank's transactions with the debtor, "the Companies," and any companies or businesses in which the debtor holds an interest.
In the eighth and final count of her complaint, Haden objects to the debtor's discharge on grounds premised upon 11 U.S.C.A. § 727(a)(3), (4) and (5) (West Supp. 1989).
Haden, in her prayer for relief, seeks a judgment against the Bank for compensatory and punitive damages in the amounts of $10,000,000 each; that Haden's claim against the debtor be established in the amount of $10,000,000; a judgment denying the debtor's discharge, or, alternatively, a determination that her claim against the debtor is excepted from discharge; and a jury trial on all issues raised in her complaint.
The debtor filed his answer to the Complaint on May 5, 1989. He does not challenge the jurisdiction of the court to hear this adversary proceeding.
II) Haden, in compliance with the pleading requirements of Fed.R.Bankr.P. 7008(a), avers in her complaint that this adversary proceeding is a core proceeding. Apparently foreseeing the possibility that the court will find her claims against the Bank to be noncore, she also avers that she "consents to the entry of final orders by this Court." At a hearing held May 17, 1989, on the Bank's "Motion To Dismiss," counsel for Haden conceded that her claims against the Bank are not core proceedings. She contends, however, in reliance upon Kelley v. Nodine (In re Salem Mortgage Co.), 783 F.2d 626 (6th Cir.1986), that her claims against the Bank are "related" to the bankruptcy case in that resolution of these claims "will impact the handling and administration of this case." Memorandum in Opposition to the Motion to Dismiss of Defendant Fifth Third Bank, p. 10.
OBITUARY
Asheville - Mr. Charles Pender "Bud" Edwards III, passed away peacefully at his home in Asheville, NC on September 10, 2014. He was the son of C.P. Edwards, Jr and Flora Massengill of Kingsport TN; grandson of Dr. C.P. Edwards, Sr. and Valeria Bailey of Asheville, NC.
Bud, a native of Kingsport, was born on March 11, 1929. He graduated from Tennessee Military Institute, attended Vanderbilt University, and served in the US Air Force during the Korean conflict and was stationed in Greenland. He was CEO and Director of all the Edwards Enterprises companies. Recognized as a pioneer and creative visionary of resort development in the South, Bud developed one of the first ski resorts in the south, Ober Gatlinburg, followed by Wolf Laurel on Big Bald Mountain, NC a 5000-acre golf and ski resort. In later years, Bud pursued his passion for antiques as a collector, dealer, student and authority.
Bud grew up with a hunting rifle in one hand and a fishing rod in the other. As an adventurous and true outdoorsman, Bud loved big game hunting in Africa and Alaska and bill fishing in the Caribbean. Bud's bear hunt in the Alaskan peninsula was the featured article in the December 1961 edition of Sports Afield. He was asked to lead a team into the Grand Canyon to test the first American imported Toyota Land Cruiser. As an enthusiastic collector of Indian relics, he was responsible for the discovery of an ancient Indian burial ground on the banks of the Holston River. He donated many of his Indian relic collections and big game trophies to numerous museums through the southeast.
Bud was a lover of life and nature, the Tennessee Vols and coconut cream pie. Graced with a generous, encouraging, and forgiving soul, a quick wit, a knack for storytelling and a rock solid memory, he was loved and will be missed by many.
Bud is survived by four children, Penn Edwards of Asheville, Amy Edwards (Jim Hensley) of Robbinsville, Brown Edwards (Lori) of Atlanta, and Scott Edwards (Ase Axberg) of Stockholm; and five grandchildren, Matthew Ensner (Megan Sommerville), Taylor Edwards, Grace Edwards, Daniel Edwards, and Molly Edwards Axberg.
